FCC Raises Concerns Over Procedure Adopted By SC Bench In Decided Matter

FCC concerns over SC bench procedure were set out in a ruling by the Federal Constitutional Court, which expressed serious concern over how a Supreme Court bench handled an already decided matter. The case relates to the Income Support Levy Act, 2013. An FCC bench dismissed review petitions challenging a ruling issued on 28 December 2021 by Justice Qazi Faez Isa.

FCC Concerns Over SC Bench Procedure Explained

That earlier judgment had invalidated the Act for bypassing proper legislative procedures. The FCC affirmed that the 2021 decision remains undisturbed.

The FCC criticised a 21 June 2022 order by a three-judge Supreme Court bench led by Justice Munib Akhtar, saying it attempted to reconsider settled questions. Chief Justice Aminuddin Khan noted that this approach breached judicial discipline and institutional propriety while the original decision was operative.

The observations stress that finalised controversies cannot be reopened arbitrarily. Such clarity helps litigants rely on court rulings and shows Pakistan’s higher judiciary setting out its reasoning in the open.

Legal Clarity in Everyday Life

Predictable judgments matter well beyond tax and legislative disputes. Rulings on family and property questions, such as the Supreme Court decision on who legally owns bridal jewellery, guide ordinary households, as do the rules in the Punjab Marriage Law 2026 fixing 18 as the legal age.

Public conversation on family life is lively too, from the divorce remarks by Saba Faisal to the candid views of Aagha Ali on love and marriage and Fiza’s simple Haq Meher. Clear law gives such debates a firm reference point.

Policy Lessons for a Stronger Court System

The central policy question concerns how courts can protect finality while still allowing genuine review. Clear rules on when a matter may be reconsidered, reasoned written orders and consistent bench allocation would reduce uncertainty for litigants.

Published guidelines on review petitions and larger-bench references could also help lawyers plan their cases. Steady adherence to precedent would reinforce confidence in Pakistan’s constitutional order for years to come.
