PTI Files Reference With SJC, Seeks Removal Of CEC

PTI Referral Against CEC Sikandar Sultan

The Pakistan Tehreek-i-Insaf filed a referral against Chief Election Commissioner Sikandar Sultan Raja before the Supreme Judicial Council on Wednesday, one day after the Election Commission of Pakistan announced its decision on the illegal funding issue. 

The reference, which Babar Awan filed, called with the SJC to oust the CEC for “committing chronic and intentional misconduct.” 

A team from the Pakistan Democratic Movement (PDM) allegedly met with the CEC and four other ECP members on July 29 in order to “pressurise” him into revealing the outcome of the case involving illegal funding. 

Election Commission Chose to Announce the Results

As a result of the meeting, the Election Commission chose to announce the results on August 2. 

The citation claimed that the CEC had broken his oath. 

The reference argued that the ECP ruling was invalid, unjustified, and illegal. It also stated that the PTI would fight the order in court.

CEC Had Disregarded His Constitutional Duties

The reference further claimed that the CEC had disregarded his constitutional duties and broken the ECP’s code of conduct. 

According to the PTI, the chief election commissioner is subject to the same code of conduct as judges of the superior judiciary, and high court judges are forbidden from discussing ongoing cases with anyone or any organisation. 

Cheif Election Commisioner Must Be Removed

The citation stated that “the CEC must be removed from one of the most revered and holy constitutional posts.” 

According to the reference, Sikandar Sultan Raja, the CEC, had rejected a number of PTI requests in the prohibited funding case, including one for a joint hearing on the funding claims of PTI and other parties. 

The Islamabad High Court granted relief to PTI by requesting that the ECP treat all political parties equally, hear their cases diligently, and resolve them in a reasonable amount of time, according to the reference.
